The Upper Tribunal has today ruled on the Independent Schools Council’s judicial review of the Charity Commission’s public benefit guidance. Its decision confirms that the Guidance is wrong in a number of key respects. The Tribunal has rejected the Commission’s request that its Guidance should nonetheless be allowed to stand until reissued, and is expected to order that substantial parts of it should now be quashed.
