A complex divorce case taken to the Court of Appeal.

We acted for a wife in a complex financial claim following her divorce, which included a major issue about the husband’s interest in a family trust. After a hard-fought trial, the High Court judge found that the husband had tried to conceal the truth behind his trust holdings. Taking the trust assets of circa £7million into account, the judge awarded our client a substantial lump sum, far in excess of what the husband had offered.

Taking his case to the Court of Appeal, the husband claimed that the trust assets should not have been taken into account. His appeal was dismissed and all of his arguments rejected. This was an important test case about trusts and divorce, and the judgments have appeared in the law reports. Our experience of handling disputes involving individuals residing abroad with offshore assets, helped bring about a very satisfactory result for our client. Just as important to our success, though, was our team’s indefatigable representation of our client against a heavily contested application.
