Clients praise Farrer & Co for its unique philosophy and client care approach.
Legal 500, 2010
We assist our clients in relation to the many legal, personal and family questions that can arise from issues of mental capacity. These include the creation of Lasting Powers of Attorney (LPAs) and Living Wills or advance decisions to plan for the future, the registration of LPAs and Enduring Powers of Attorney at the Office of the Public Guardian and applications to the Court of Protection for the appointment of a Deputy or other orders under a Deputyship such as the making of gifts, statutory wills or sale of property.
We advised on the first case of a statutory will to come before the Court of Protection, “In the matter of P” in 2009. We are also experienced advisers on contentious Court of Protection matters and where there are complex cross-border issues.
A discreet and sensitive approach
We understand the need for sensitivity and discretion in working with our clients through difficult times to find pragmatic resolutions to problems arising from issues of mental incapacity, whether relating to elderly people or to those suffering from a medical condition or illness.
Since this is a developing area of law, we monitor every new piece of official guidance, legislation and case law, giving you a deep pool of knowledge and understanding of all the issues. We use this knowledge in a clear and practical manner, presenting you with the key issues and recommendations for the best solution.
