Domicile & residence

This expanding team has attracted an impressive range of work in offshore and onshore matters, advising a growing number of families and individuals from Russia and Asia.

Chambers & Partners

The law on residence and domicile is complex, and individuals with international backgrounds can often find themselves in need of professional advice to determine whether they and their families are resident and/or domiciled in the UK.

We have a wealth of experience in advising individuals and their families on their domicile status, the effect of domicile on succession planning and planning opportunities for non-UK domiciliaries.  We also advise on the residence of trusts and companies, which is often relevant to high-net-worth individuals with cross-border interests and to their family offices.

Our advice

We advise international individuals and families who are planning to move to or invest in the UK, setting up the appropriate structures and financial arrangements to ensure that the correct succession plans are put in place and tax exposure is mitigated where possible. We are well versed in the remittance basis of taxation, including more complex areas such as funding the purchase of UK property through offshore loan arrangements.

We also advise clients who are planning to emigrate from the UK on the potential tax and cross-border succession issues and ways in which those issues can be resolved.
