We draw on our wealth of property, banking and regulatory experience to provide a specialist service to clients looking to secure loans against commercial, high-value residential or agricultural property.
We are instructed by both borrowers and lenders (in particular international commercial and private banks) and sometimes by both in a transaction. We also act for private lenders, e.g. trustees or charities lending money. So far as borrowers are concerned, our clients include individuals, property investors (both for development and for income) and landed estates.
We are market leaders in dealing with loans to high-net worth individuals, trustees or special purpose vehicles (which might be onshore or offshore) and understand the specific concerns which can arise. The loans with which we are involved can vary in size from £1 million to well in excess of £100 million.
We advise on the structuring of the transaction as well as dealing with the execution of the security formalities. Where appropriate, we can also prepare or negotiate bespoke credit facility documents and security and intercreditor arrangements.
The breath of our property expertise makes us particularly well-placed to deal with almost any property which might be proposed as security. From development property to rural estates we can advise on the particular issues involved in the associated financing and put together a team which is tailored to the transaction.
A number of the banks for whom we act have also sought our assistance in expanding their English and Welsh lending practices. We have assisted them in developing their regulated mortgage and other security documentation as well as providing more general advice on the compliance aspects of such an expansion. We are a member of the Council of Mortgage Lenders and of the Loan Market Association and run regular seminars (to our clients and to key members of the industry) on topical issues.
