Bethan advises lender and borrower clients on all types of domestic and international banking and financing matters. She has a market-leading art finance practice and specialises in advising banks and borrowers on lending against moveable assets and collectibles. She also advises charities and not-for-profit organisations on their funding requirements.

Bethan’s practice spans asset and structured finance, as well as advising charities, trusts and institutions on raising finance secured against real estate or other assets. She regularly acts for private and investment banks, non-bank lenders, family offices, high-net-worth individuals and families, charities and institutions on their lending and borrowing needs.

Bethan specialises in transactions secured on moveable assets – including art, business aircraft, yachts and collectibles including jewellery, fine wine, handbags and classic cars, as well as real estate. She also works closely with other teams across the firm to support the lending requirements of individuals, families and their businesses.

Bethan greatly values the variety of her practice. Recent examples of her work in art financing and asset-backed lending include:

  • Advising several private banks and non-bank lenders on lending secured against portfolios of fine art, super cars, jewellery, IP rights and real estate.
  • Helping several wealthy international families raise finance against or assist with their purchase or re-register business jets.
  • Assisting a private bank in lending to a well-known landed estate in order to acquire another neighbouring property for development.
  • Assisting a charity on the refinance and restructuring of its joint venture arrangements with its joint venture partner.

Secondments at a private and an investment bank have given Bethan a valuable insight into how clients operate, which helps her to manage transactions effectively and smoothly, often to tight timeframes. Bethan is highly motivated by client satisfaction and is recognised by clients and colleagues as a responsive, capable, calm and personable lawyer who is willing to go the extra mile to deliver what is required.

Bethan's work almost always has an international element. She is actively helping to develop Farrer & Co’s international network through her membership of international associations and by speaking at international conferences.

Work Highlights

Multi-jurisdictional art and luxury asset financing and subsequent enforcement: advised an international special situation fund as lender on the negotiation, implementation and subsequent enforcement, litigation and partial settlement of $40 million loan made to a high-net-worth individual and secured over art, IP rights in art, classic cars, property and shares.

Art gallery financing: advised a Bond Street art gallery on its ongoing finance requirements, including the financing and refinancing of £20 million of term and revolving loans and the addition of a £10 million revolving credit facility to be used for short notice artwork purchases.

Cross-border luxury asset portfolio financing: advised an international specialist art and luxury assets lender on a cross-border loan of $18 million secured against a portfolio of artwork, jewellery and gemstones.

Counsel to specialist art and jewellery lender: we are leading English finance counsel to a specialist art lender and advisor, assisting in developing precedent templates, advising on art lending transactions and assisting with several intra-group loans.

Aviation finance: advised on the refinancing of a Bombardier Global 6000 and subsequent enforcement sale following the death of the borrower.

Collectible cars finance: advised an ultra-high-net-worth individual making a loan secured against multiple rare cars worth approximately €40 million, which included drafting finance documents and advising on the implications of the cars’ storage arrangements. 

Yacht finance: advised a private bank on taking security over a yacht to secure loans made to a high-net-worth client.
