The implementation in May 2018 of the General Data Protection Regulation (GDPR) (and the linked Data Protection Act 2018) means data protection law is in the spotlight as never before.
With that increased attention comes a whole range of regulatory, commercial and reputational risks for organisations. Regardless of the size of your business, or the sector in which you operate, understanding and complying with data protection and wider information law is now crucial.
With extensive experience advising in this field we have an in-depth understanding of the challenges our clients face in addressing this fast-changing area of law and practice, and we have developed formidable technical expertise around the relevant legislation and regulatory guidance.
Our expertise goes beyond data protection. We are one of the few London-based practices with dedicated freedom of information and environmental information expertise. We help public authorities understand their obligations, comply with requests and deal with complaints to the Information Commissioner’s Office (ICO) and appeals to the Information Tribunal and Upper Tribunal. We also advise clients who share information with public bodies subject to this legislation and help them to understand the implications and key issues to consider.
We advise our diverse client base on data protection issues, often with particularly complex or sensitive dimensions. We know that data protection issues do not exist in a vacuum: we work closely with colleagues across the firm (including specialists in reputation management, safeguarding, employment, financial services and litigation) to ensure our advice brings to bear wider expertise and an understanding of the particular contexts in which our clients operate and the pressures and opportunities they face.
Our experience ranges from assisting with, and advising on, data protection and e-Privacy compliance projects, to advising on subject access requests, dealing with ICO investigations, advising on the compliance issues surrounding direct marketing (both in a commercial and charity context) and the aggregation of data for commercial use. We also frequently advise clients on complex cross-border data transfer issues and data protection concerns in wider commercial and corporate contexts.
While larger public bodies often have dedicated freedom of information (FOI) teams, we help those organisations who need specialist advice on handling particularly difficult requests, especially where sensitive information is involved or where the application of relevant exemptions under the legal regime is especially complex. Often FOI requests come in the context of a broader issue or dispute and we help ensure public authorities meet their obligations without losing sight of that bigger picture. We also advise non-public authority bodies whose information is subject to FOI requests in the hands of a government department or regulator.
Our practice ranges from advising on exemptions and the public interest test to drafting submissions to the ICO and representing clients in the Information Tribunal and Upper Tribunal.
